Item 17 and 18 are two ordinances that pertain to certificates of participation for the Open Space Fund.
Item 17 is an ordinance to approve the issuance and sale of COPs, the certificates of participation, in one or more series on a tax-exempt and or taxable basis by the city payable from the base rental secured by net open space fund property tax revenues to finance or refinance certain projects in an aggregate principal amount of $43 million to approve the form of the property lease.
to authorize the sale of the certificates, to approve the form of an official notice of sale and notice of intention to sell the certificates, to direct the publication of the notice of intention to sell the certificates, to approve the form of the purchase contract and one or more initial purchasers of the certificates, to approve the form of an official statement in preliminary and final form, to approve the form of a continuing disclosure certificate,
to authorize payment of costs of issuance and to declare the city's official intent to reimburse itself for certain costs from the proceeds of the certificates.
And item 18, this ordinance appropriates the 43 million in COP's series 2026A for the open space fund recreation and park proceeds to the recreation and park department for fiscal year 2026 through 2027
and to place these funds on controller's reserve pending the receipt of the certificates of participation proceeds.
