Uh remember there's one called Dyer in Westminster City Council or Dwyer, not hasn't Danny Dow at Dyer, which basically said that um
After forty years of non use and you know passageway being blocked up and easement hadn't been extinguished and
There was Ben and Harding, which was they didn't accept an easement to be extinguished after one hundred and seventy five years non use.
The best way of extinguishing rights of way is
is by uh the surrender, you know.
Preferably by deed and expressed deed of surrender.
And that's probably the one the Londoners will accept only.
There was a case called George Wimpy and Soan, which I don't think I mentioned in the course in nineteen sixty seven, which basically said uh if it's just uh access and that's it, that's not adverse possession, that's not intending to possess then factually possessing the land.
I'm pretty much the same as private bodies, quite honestly.
And that's just uh again, if the title's registered.
One of the reasons they changed the law in 2003, but not retrospectively for registered land, it was to encourage first registrations, voluntary first registrations for things like public land in particular.
Because some public bodies and particular central government are massive landowners.
And the best way of protecting is getting the title registered.
registered because then unless this person making the application has got a boundary, actual boundary, and there's a reasonable mistake is the boundaries, they are likely to fail.
And also police the land.
And it's no different between public and and private and bodies.
If you're given a license, just like if you're given a lease, it can't be adverse possession because
You've got permission to be onto the land.
If if you stop exercising the license as a pie and gray em where they were given a a license for to be on the land and they no grazing rights and they were paying money for it, then they just stopped paying the money from that moment onwards, then the adverse possession claim can start.
Basically, if it's registered land two thousand three onwards claims, it's Schedule Six, paragraph nine.
