elections, where the Elections Clause in the United States Constitution says that elections are predominantly an area for states to determine the time, place, and manner of those elections.
So they do try to use the law as a cudgel with very robust, expansive, incorrect interpretations.
But being a sanctuary jurisdiction, a quote-unquote sanctuary jurisdiction, is nowhere near the line.
And don't just take my word for it.
The Ninth Circuit already decided this issue.
It's done and dusted, decided already back in Trump 1.0 when the Ninth Circuit said that SB 54 is upheld and fully within California's Tenth Amendment constitutional rights.
Something like...
physically obstructing, you know, assaulting a immigration officer in the lawful execution of official duties of immigration enforcement, you know, that's something that crosses the line.
That's what obstruction is, interference is, but not a state executing its constitutional rights under the 10th Amendment to be a pro-public safety, pro-public community trust jurisdiction.
I'll first say that we are in some unprecedented, uncharted territory.
Unfortunately, there has long been a spirit of cooperation between the federal government and state and local governments when it comes to, for example, a crime that occurs in a state and there could be concurrent, overlapping crimes.
jurisdiction, there's been sharing of the evidence, sharing of access to the crime scene, the ability for each jurisdiction to fulfill their roles.
But the federal government has changed in its position and shown a unwillingness to cooperate after the murder, excuse me, the killing and maybe murder of
TBD of Renee Good, the federal government immediately said it would not investigate.
And the tradition has been for the United States Department of Justice Civil Rights Division to investigate, at least look, gather the facts, pull them together.
Maybe you conclude that there is no reason to take any additional steps, but you won't even look.
You don't even care about the facts.
You're just going to decide.
It seems so purely political.
And I think the whole country saw that.
