One of the most dramatic changes we have, the set of amendments that come after the Civil War, the Reconstruction Amendments, as being at least an example of something about the dynamic or the plastic character of the Constitution and the ability to revise it and how that plays into the question of whether or not the whole question is about property and the protection of property as opposed to liberty and the protection of liberty and individuals.

And I guess my own thought on it is that part of liberty is underpinned by the possession of property.

There is also the part of liberty I think that maybe we most naturally think of first, which is being able to pursue our own happiness and our own flourishing in our own ways and our own terms.

with, you know, the caveats regarding sort of us being together in a community and so forth.

And I think that you do see that with the reconstruction amendments, because you have the individuals who were excluded from the rights of the Constitution being explicitly brought into that.

And so there's an acknowledgment of their liberty

and what it means to be a person and a citizen that is underpinned, even more than, in some ways, the Bill of Rights.

The Bill of Rights aren't part of the Constitution.

Well, aren't part of the original drafting of the Constitution.

They are amendments that are added in that are about individual, often individual liberties and individual protections against the reach of the government.

But I think you have that underlined with the reconstruction

Well, but Russell's talking about not the problem of corporations being understood as people for the sake of speech.

He's talking about the problem of corporations having, I'm just putting words in your mouth, but the problem of corporations having power outsize of individuals or even individual communities.

And that there's something unbalanced and maybe unforeseen about the level of power influence where you have some corporations that can be individually some enormous percentage of the GDP or something like that.

And that kind of imbalance doesn't seem to be explicitly established.

My answer to that would be, I think that that observation is basically right, but that means that we have to have a revision.
