Well, I think what we need to make really clear is that the filibuster is not a constitutional requirement, right?

It's not embedded in the Constitution.

It's just a rule that came up in Congress.

The House has used it and the Senate has used it because both Congress has to use it.

You have to have 51 votes instead of 60.

And by that slim majority, you can codify laws.

And I think what people don't seem to understand is

Yes, every couple of years it's used, but it was first used and first implemented to thwart civil rights legislation.

That is the history of the filibuster.

And you remember back in the day you would have to get up on the floor of the Senate and talk for hours and hours and hours?

You don't have to do that anymore.

So it's very easy to say, I'm going to filibuster.

And what they have done is, in terms of filibustering is...

Now you have Roe v. Wade is not codified.

The John Lewis Voting Rights Act, not codified.

You have things like gun control, not codified.

The Justice and Policing Act.

So you have all these things that aren't codified.

And what that really means is that it's minority rule.
