I I think that's true as well.

I mean I think um

There and there's a lot of risk in terms of um penalties that could be imposed for improper disclosures.

You know, there are always um it's always necessary to look about and think about state law requirements.

Uh in HIPAA itself says that if the state law is more protective of pat patient confidentiality

uh then you have to follow the state law, not HIPAA.

It's not a enough necessarily to follow HIPAA if your state law has uh something in it that is more uh restrictive than HIPAA does.

So you've got to know what your state law requires.

Um, there could be additional

Restrictions in state law protect you know, such as additional notices to patients beyond the satisfactory assurance requirements of HIPAA.

Or there could be special rules in your state uh for

types of records like mental health records or not just substance use disorder treatment records, but mental health records, um, or reproductive health records or, you know, any kind of um category that a particular state has

made uh specific requirements about.

So it's it's very important to have

uh a protocol uh at your at your facility uh for responding to subpoenas and to include

an an analysis of state law requirements as part of that process.
