I think that the original sin here, like of all of this, and I find it genuinely fascinating is that there is this racial essentialist philosophical commitment in the law.
It's baked into the law.
The reason everyone is always, well, have we done enough here?
Is it time to sunset these laws?
Is because everyone knows
that this sort of affirmative discrimination or affirmative bias in the law, whether you're discriminating against people because you dislike them or because you want to help them, it is antithetical to the principle of equality under the law.
It is antithetical.
They're at odds.
We're trying to remedy some past harm by making the law do something that we know is at odds with the spirit of the Constitution.
And as a result,
The argument she has to level is, well, no, no, I mean, we just haven't done enough yet.
I mean, they're basically just children.
We need to help them.
And in her case, Supreme Court Justice essentially making an argument because she self-identifies this way, you need to help us.
Like, you haven't done enough for me.
I find the entire thing pretty obscene, but I also think we're uncovering something here.
And to the extent that there is a correction here that's being made by the Supreme Court, and we've seen a number of rulings along these lines that suggest that people are well past this.
Even in California, they've managed to knock down affirmative action efforts there.
People want equality under the law.
