A voting rights group called the National Redistricting Foundation has filed a lawsuit in state Supreme Court.
They claim the Republican governor's calling of a special session in April to draw new congressional districts violates the separation of powers clause in the state constitution, arguing that power belongs to lawmakers.
Redistricting is usually done after the national census every 10 years.

Republicans are appealing a judge's decision to redraw the lines of New York City's lone GOP-controlled House seat currently held by Nicole Malliotakis.
A judge ruled last week the district was drawn in a way that dilutes the impact of black and Hispanic voters, even though Malliotakis is of Cuban descent.
The judge ordered the state's independent redistricting commission to draw up a new map by February 6th.
