For more than a decade, expedited removal had only been used in cases where migrants were detained within 100 miles of the southern border,
or if they'd been in the country for less than two years.
In all other cases, unauthorized migrants were granted the same due process rights that apply to anyone in the country, regardless of citizenship status.
But in a two-to-one decision, the D.C.
Circuit Court of Appeals says that ICE can rapidly deport any migrant who can't prove they've lived in the U.S.
for two years or more.
meaning they're not owed any immigration hearing processes, even if they're seeking asylum.
An expedited removal order cannot normally be appealed and in most cases comes with a five-year ban on reentry.
