I think we're wrong to be doing this as a criminal violation.
If you've got somebody who's going to get nailed by
for an impulse noise on a construction site, a one-off or somebody running a backhoe, somebody running a bulldozer, somebody running a hammer, and then they get a criminal citation for it, you can kiss their CDL goodbye.
If they're a pilot, you can kiss their pilot's license goodbye, especially if they get repeated criminal violations.
And there's still the issue of who do you criminally violate?
If it's an operating Amazon data signer, and I've said this before, are you going to cite the manager?
Are you going to cite the security guard?
Are you going to drive down to Georgetown and pin the citation to Jeff Bezos' nose?
I think we need to look at this holistically, and I think we need to figure out where we need to go, whether it's all criminal, part civil,
Or part civil, part criminal, or all civil?
Because we've got a couple of options.
But until we take care of that baseline question, I think we're going to be spinning our wheels a little bit.
