The border regime governing Ceuta and Melilla is different to the rest of Europe, and pushbacks are permitted if there is a physical barrier.
In the case of the land border between Morocco and Ceuta, that's very evidently the case.
But with the sea, it's a little bit murkier.
Now, there was a Supreme Court ruling in early July, which came from a case where an Algerian migrant swam this four-hour swim.
And he argued that he had not crossed a physical barrier and therefore shouldn't have been pushed back.
Now, the Spanish Supreme Court said that actually that was technically correct.
So this ruling came in early July and information spread about it online.
It was wildly exaggerated and people started to say, you know, the border is open.
