And also a very good idea is to name replacement attorneys so that if the worst happens and you have named, say, your spouse, but at the point when you've lost capacity and somebody needs to step in,
Your spouse has sadly pre-deceased you or unfortunately also lost capacity.
You don't want to have created a redundant document.
So always a really good idea.
And we recommend this in all our advices that you have named replacement attorneys.
On the question about whether somebody who has a history of mental health difficulties is able to do this, absolutely they are.
They will be producing, for the purposes of an EPA, that capacity statement which says they're fine, they understand the implications.
And that question also calls into discussion the Advanced Healthcare Directive, which is a separate document.
So apart from the EPA...
making an advanced healthcare directive is a really good idea because that takes care of future treatment decisions.
You can't do that by way of an EPA.
