The new attorneys for an illegal migrant convicted of murdering a Georgia nursing student, Lakin Riley, were back in court today arguing that he should receive a new trial.
The attorneys for Jose Ibarra say his trial attorney did not ask for a competency evaluation ahead of proceedings and that they believe he has a congenital deficiency that makes him incapable of preparing for and participating in his own defense. After Ibarra was convicted and in response to this motion from his new attorneys, the judge ordered a mental evaluation last summer. And said Friday, that assessment found Ibarra was competent and had been at the time of trial a year prior. Ibarra was convicted of murdering 22-year-old Laken Riley while she was jogging on the University of Georgia campus in Athens. Prosecutors say Ibarra tried to sexually assault Riley before killing her. His DNA was found under her fingernails.
