Chapter 1: What is the main topic discussed in this episode?
Today's episode was made possible by our friends over at CommBank. Ready?
And good morning.
This is the Daily Oz.
This is the Daily Oz. This is the Daily Oz. Oh, now it makes sense. Good morning and welcome to The Daily Oz. It's Friday the 5th of June. I'm Lucy Tassel. I'm Emma Gillespie. Over the last week or so, you might have seen some social media posts, some news articles about the outdoor gear company Patagonia suing a drag queen called Pattygonia.
Patagonia alleges that Patty, whose real name is Wynne Wiley, is infringing on its trademark, while Patty says Patagonia is trying to erase her advocacy.
Patagonia told the media they're only suing me for a dollar. What they're actually trying to do is to take away my name permanently. This is not a brand conflict. This is a corporation trying to erase an activist.
In today's episode, I'll unpack this very full hiking backpack of a story. But first, here's a quick word from Sam.
Hi, my name's Sam. I'm the co-founder of The Daily Oz. Firstly, thank you for watching and listening to this podcast today. When Zara and I started this company almost 10 years ago, we did not think that we would get to where we are today, but we've got a long way to go.
And for us to continue to get excellent guests and continue to hire journalists who bring you the explainers that you love, we need to show the world that we've got a following behind us, and you can help with that. If you're listening on Spotify or Apple, just go to our podcast show page and the follow button will be there at the top.

Chapter 2: What is the lawsuit involving Patagonia and Pattie Gonia about?

Lucy, you have been very passionate about this story all week. I have been a beneficiary of that passion. But I think that this is such a fascinating story and one that a lot of people will find interesting, even if they know absolutely nothing about it at the ground level like I did a few days ago. Yeah. Can you start by explaining who the main characters of this case are?
Yeah, so we've got Patagonia, which is the famous outdoor gear company. They sell clothes, they sell bags and like literally everything you'd need to go out into the wild.
Yeah, when I think of the brand Patagonia, I think weatherproof, sturdy. Exactly.
All the stuff that we're not really interested in, which is why we're sounding so vague.
Yeah.
Adventure gear for indoor girls like us.
Exactly. So it's named after the Patagonia region in South America, which a lot of people have pointed out as this case, it will become clear if you're not familiar with this case. Patagonia also has an environmental deal set up a few years ago where basically a non-profit, an environmental non-profit owns 98% of the company and
It doesn't own decision-making power, but it basically means that this environmental collective gets Patagonia's profits to spend on environmental causes.

Chapter 3: Who are the main characters in the Patagonia lawsuit?
And then they kind of have to do that or take that action if they want to protect their trademark and if they want it to stay active and strong because there is a time limit on when they can pursue legal action here.
Yeah.
A lawsuit feels like a big move. I'm wondering if they had ever chatted, had any kind of mediation, had Patagonia the drag queen and Patagonia the brand interacted before we got all the way to the point of a lawsuit?
Yeah, so back in 2022, after Patty the queen started exploring a deal with the water bottle company Hydro Flask and the outdoor gear company North Face. So Hydro Flask... contacted Patagonia saying, we're actually setting up this deal with Patty. We want to make sure everything's legally sweet. Interesting. Let's chat.
They have, based on my reading of the legal documents, like a conference call chat, and then Patagonia's legal filing is includes screenshots of emails that they sent to Patti after that meeting, where they say, basically, we all agree, we have asked you not to use our logos, quote, or any substantially similar designs.
And these emails that are in the legal docs, they also say that Patagonia has asked that Patagonia, quote, not use Patagonia in any form on products. Wait, what?
All right, so that email then to me implies Patagonia was saying to Patti, totally cool for you to work with Hydro Flask. You can take a photo with their water bottle, put it on your Instagram and be like, hey, love this bottle, but you can't make a bottle with them to be like the Patagonia Hydro Flask.
Yeah. Got it. And these emails basically say, we have all discussed this and you have heard us explain this. We all agree you heard us say this.
So was there an attempt at a resolution then? Did Patty respond to that suggestion? I mean, clearly it escalates.

Chapter 4: What are the similarities between Patagonia the brand and Pattie Gonia?
Lucy, I'm delighted to bring you one of the weirdest stories I've seen this year. Awesome. Courtesy of the ABC, a truck carrying beehives rolled over in southwest Queensland this week, leaving an angry swarm and destroyed hives. There was a huge cloud of bees, a swarm that Onlookers described as looking like a big, dark, shadowy cloud.
Nightmare.
Traffic had to be diverted. A bunch of drivers rolled down their windows to check out the action and see what was happening.
And got stung.
And they got stung. The bees flew into their cars. It was absolute mania. An SES volunteer, Wayne Bryant, spoke to the ABC. He was on the scene. He said, we've got a pile of destroyed hives and a swarm of angry bees in about a 10-metre radius around the truck. He was doing his best to divert traffic, but he said that from about 30 metres away he could still see the big cloud of bees. Yeah. Yikes.
Traffic was closed in both directions, so I'm sure it was a massive disruption to everyone's day on Wednesday. But now that they've had some time to put the calamine lotion on, I hope everyone's okay.
That's unbelievable.
