Hi guys, welcome to an episode of Legally Brunette. I'll be your host today, Emily Simpson, with

Okay, today is a very special episode because we are going to talk about um every every month we've been trying to bring you new stories of wrongful convictions. And so we're super excited to be first of all, we're in person today. We're in the iHeart Studio, which normally Shane and I are at home. But um we are in the studio today with Kevin Harper, and we're very excited to talk to him. Um before we start to um interview Kevin, I just want to go through a little bit. Of his bio so that you guys have a background on Kevin. So for 13 years, Kevin Harper Jr. sat behind bars for a crime he did not commit, the death of his own infant son. In August of 2008, Kevin rushed his six-month-old boy, Jaden, to the emergency room after the baby stopped breathing.
Jaden had been born 13 weeks premature and battled serious health complications from day one. Despite Kevin's desperate attempt to save his son's life, doctors identified a cluster of findings, brain bleeding, swelling, and retinal hemorrhaging, collectively known as the triad, and concluded that the baby had been shaken. Kevin was convicted of causing his son's death and sentenced to 25 years to life in prison. However, he never stopped proclaiming his innocence. What prosecutors didn't account for was a growing Body of medical science challenging the very diagnosis that put Kevin away. The so-called shaken baby syndrome triade, it turns out, can have other explanations. Explanations that were never presented at trial.
While incarcerated, Kevin earned his associate's degree, led life improvement programs for fellow inmates, and held on to the hope of reuniting with his daughter. his mother, and his grandmother. On January twentieth of twenty twenty two, thanks to the tireless work of the Northern California Innocence Project, Cooley LLP and Latham and Watkins, Kevin Harper walked free.
