What is the purpose of the hearing and the initial rate‑case issues?

Judge Moder (Hearing Officer) [Unknown] 0:00
Let's go on the record. Good morning, everyone. Welcome back to the Arizona Corporation Commission. We are resuming the hearing today in TP's rate case, docket number ending twenty five dash zero one zero three. I have a couple things to start with, mainly for Mr. Patton. So I had mentioned the prior financing order that I wanted to um ask Mr. Radmaker about. So I just wanted to clarify one thing in case you think there's a different witness who should testify ab about it, but the If you look at it, you'll find in the ordering paragraphs that the reference point for the cap on the equity ratio is the company's quote then most recent rate order. Now, if an ARAM is approved, then I think rate order becomes a little ambiguous.
Judge Moder (Hearing Officer) [Unknown] 0:57
So I need to hear from the company their position on whether. That is just gonna mean this rate case decision or could also mean the annual A RAM filings and I also think that this is an ambiguity that probably needs to be corrected um in this case, maybe via forty two fifty two or something like that. So whoever's best equipped to kind of testify about that. Okay. Yeah,
Mike Patton 1:32
I'm not sure there's someone who I I I think our interpretation is it's The initi the rate case order here, I don't believe that a Aram adjustment is a rate case.
Judge Moder (Hearing Officer) [Unknown] 1:44
Well it says it says rate order, not rate case order. Okay. So I I just have a little concerns uh some concerns about leaving that um as it stands. If it said rate case order, I wouldn't have the concern. Um, so I just want to hear the company's position on that. Um, I'm also interested to hear from you, Mr. Patton, on the company's plans to respond to the letter that was filed in the docket yesterday by Commissioner Walden. Um, in part whether we need to recall if there's an intent to recall any witnesses to address that because some of it covers topics that we've gone through or I just wanna get the company's plans for that on the record.
Pat Carroll 2:30
Um we we often get those kinds of letters from commissioners asking for information and uh the way that we've handled this in the past is um we respond to the letter with the requested information by filing that information in the docket. Um there was no indication in the letter that she wanted it f for specifically while this rate case hearing and our plan is to uh have uh Ms. Bulkley be able to go back and and look at the um uh other companies that she requested. At the same time she's asking for some new depreciation analysis um that we would end up doing. Um and so our plan would probably be to file that information. for the commissioner in the docket probably after sometime after the hearing is over.
Judge Moder (Hearing Officer) [Unknown] 3:25
Okay. All right. Thank you. That was all that I had. Does anyone else have something that they'd like to discuss um preliminarily today?
Miss Barrio-School (RUCO attorney) [Unknown] 3:35
I have one thing, Your Honor. Okay. May we once again have your permission to dress casually for Friday tomorrow? Yes, you may. Thank you.
Mike Patton 3:44
And Your Honor, just in terms of witness um scheduling, uh if we finish the three cost of capital witnesses today, which I think we will, our intent is to put Mr. Rodemacher back on the stand.

Miss Reyes (camera comment) [Unknown] 4:29
