Your Honor, in my cross-examination of Mr. Dang yesterday, I asked you to take administrative notice of a FERC decision, which was identified as Exhibit AZLCG 25, and you asked me to report back to you on whether or not there were any reconsiderations or rehearings or appeals of that decision. And if I may, I'm prepared to provide that report this morning.

In the case that is the subject of the exhibit and the opinion number 501, Multiple parties filed for rehearing in that case, and there was a subsequent FERC decision, which was numbered opinion number 501A, In that decision, the FERC did not change the screening tests that were the things that were cited in Mr. Pollack's testimony. However, the FERC did reapply different data to the tests and so granted rehearing, changing the outcome of this specific case to a degree, but not changing the underlying tests. I will also note that the utility, the Southwestern Public Service, as part of rehearing, argued that there should be some additional analytics specific to their facts and circumstances that ought to be considered by the commission.

I actually may have to object to this because there have been a number of compliance filings that have modified the criteria over time. An example is 169 FERC at 61,041. The actual names have evolved over time as well for the three-part tests. They're no longer called what they were, and they've modified their criteria slightly. So I'm not sure if that decision is actually still applicable, and you should take notice of it based on the subsequent compliance filings that have adjusted the test.
