All right, good morning everybody. Um so we are starting our February open meeting and I have 500 monitors here, so bear with me. All right. Um so first I guess let's start with a uh prayer and a pledge. I'll do a quick prayer and Commissioner Thompson will do the pledge. Heavenly Father, we thank you for the opportunity to serve today. Um we ask for wisdom, humility, uh, and grace in the work that we're gonna do today. Guide our decisions uh through your son, that we may act justly, speak truthfully, and serve the people entrusted to us with integrity. In your son's name we pray. Please join me in our pledge. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God and invisible, with liberty and justice for all.

All right, thank you. Um now we have So the for the first item of business we have um five items on the uh consent agenda that are subject to uh forty two fifty ARS forty two fifty twos. Those items are seven, ten, eleven, twelve, and thirteen. That's Union Pacific, Caya Cayetano, Rio Rico, Sunrise and APS, um, CEC. So if there's any parties to that that that n would like to speak, now's the time. I'm not seeing anybody. So now um I guess I'll ask my fellow commissioners if there's other items that are currently on consent that need to be moved to the regular agenda. Nothing. All right. Um With that, I guess We have everything. There's also an amendment um from hearing on item number five. So Um Vice Chair, if you want to move the hearing amendment real quick, we'll do that and then do the consent.

Good morning, Chairman, Vice Chairman, and Commissioners. Thomas Abshire, on behalf of Utilities Division staff. Agenda item 17 is the application of Bacara Power LLC for a certificate of environmental compatibility authorizing the Project Bacara. The project consists of a new approximately 700-megawatt natural gas-fired combustion turbine generation facility. The project will interconnect to the APS 230 kilovolt transmission system through a new APS-owned substation located on the eastern edge of the project site. The Line Sighting Committee held evidentiary hearings on december first through December fourth to receive evidence and deliberate on the application. Subsequently, the committee voted eight to one to approve the CEC.

Thank you, Chairman, Commissioners. ARS forty-three sixty asks the committee to balance a number of factors. The need for reliable electric service, the impact on existing and planned land uses, the protection of the environment and public health, the impact on scenic, historic, and natural resources, and weather unbalanced, this facility serves the broader public interest. So the site, the project site, approximately 160 acres, it's next to Luke Air Force Base. It's been zoned heavy industrial since 2000. So 25 years it's been zoned for this type of use. It's the sites in close proximity to transmission lines, fiber network, natural gas pipeline, and an underground propane storage facility. Um the applicant will conduct a class three cultural resources survey for the entire site.

Uh on the air side there's their air permit for a non major new source is pending before Miracle County. and it would limit the plant to an approximately thirty percent capacity factor.
