What is the purpose of this pre‑hearing conference and who are the parties involved?

Chris Nichols 0:01
All right, let's uh go ahead and go on the record. Good morning everyone. This is the time set for a prehearing conference in the matter of the application of Navapatchy Electric Cooperative Inc., an Arizona nonprofit corporation, for determination of the current fair value of its utility plant and property. And for the establishment of just and reasonable rates and charges designed to realize a reasonable rate of return on the fair value of the planted properties and for related approvals, docket number E zero one seven eight seven A twenty four. Zero two seven eight. I'm administrative law judge Chris Nichols and I have been assigned to preside over this matter. Let's begin by taking appearances of the parties beginning with the applicant Navapachi Electric Cooperative Inc.
Megan Grable 0:52
Morning, Your Honor. Can you hear me?
Chris Nichols 0:54
Yes, thank you.
Megan Grable 0:56
Thank you. This is Megan Grable of Osborne Maladon on behalf of Navapachi Electric Cooperative. Also with me from my firm is Elias Ancharski, and with us from the cooperative is Josh Adams.
Chris Nichols 1:09
Good morning to you all. And who do we have today on behalf of staff?
Robert Reiden 1:17
Good morning, Your Honor.

How did the parties outline the hearing schedule and witness plan after reaching a settlement?

Robert Reiden 1:17
Robert Reiden on behalf of staff. Also online is Bridget Humphrey, and joining us is Britt Baxter, Jacob Vaughn, and Taylor Shell.
Chris Nichols 1:28
Good morning to all as well. All right. So the purpose of today's uh prehearing conference is to give the parties an opportunity to address any procedural matters that we need to take care of in advance of the hearing to begin on October twentieth. Uh I see that according to the settlement agreement, the parties have reached an agreement on all issues. So my question is where does that leave us for purposes of a hearing schedule? Uh have the parties discussed a tentative schedule in terms of how much time will be needed and who will be testifying and what the schedule might look like in that regard. Uh I'll begin with uh Ms. Grable.
Megan Grable 2:07
Thank you, Your Honor. Um, Nav Apache does not think the hearing needs to be very long. As as we noted, if we have reached a settlement on all issues, we've stipulated to the admission of all of the exhibits. And so we intended to put on one witness, Josh Adams, who is here today, um, to testify in support of the settlement agreement. We will also have a rate consultant available if your honor has questions that detailed questions that um Miss perhaps Mr. Adams is unable to answer.

Why is an issues matrix being discussed even though the case is settled?

Megan Grable 2:33
But but we suspect we can probably create a good year and then rather quickly.
Chris Nichols 2:39
Thank you, Ms. Grable. uh Mr Ridenauer.
Robert Reiden 2:44
Thank you, Your Honor. We intend to put on Renel Palladino as our settlement witness and we will have all other witnesses that file pre-filed testimony available for any questions that you or the other side may have.
Chris Nichols 3:00
All right, I think that sounds reasonable. Um With respect to any uh pre filed testimony that's been submitted so far, do the parties anticipate any last minute corrections or other changes to any testimony or schedules, uh Ms. Grable?
Megan Grable 3:18
Nav Apache does not know.
Chris Nichols 3:21
Mr. Reidenhower?
Robert Reiden 3:22
Staff does not either, Your Honor.
Chris Nichols 3:24
And I presume there are no objections to any exhibits that have been filed so far, Mrs.

What staff‑recommended adjustments were considered and how did they affect the settlement?

Chris Nichols 3:27
Grable?
Megan Grable 3:30
No, you're on, they're not. As I said, we've stipulated to the admission of the exhibits.
Chris Nichols 3:34
No, Your Honor. All right. Um So uh I do believe that an issues matrix was required by the the procedural order. um originally filed setting the hearing. I realize that the parties have settled on all issues, but um I wonder if the parties were still planning on filing an issues matrix, uh Ms. Grable?
Megan Grable 4:02
hadn't discussed it, Your Honor, but we can certainly put one together if you would like one.
Chris Nichols 4:07
Um You know, uh given that there were initially some um Some issues upon which staff recommended some adjustments. Um I think it would be helpful just to have a a pretty uh cursory thirty thousand foot level uh issues matrix.

Which exhibits have been filed and are any additional exhibits expected before the hearing?

Chris Nichols 4:25
Um Mr Reidenhauer, any objection to that?
Robert Reiden 4:28
No objection, Your Honor.
Chris Nichols 4:30
Ms. Grable, would that be all right?
Megan Grable 4:33
We can get that done.
Chris Nichols 4:34
Thank you. Um, and any time in advance of the hearing would be just fine. Um And I wonder w were there any issues as to which staff recommended an adjustment um compared to what was proposed in the initial application?
