In that case, let's go on the record. Uh good afternoon, everyone. My name is Donna Sansone and I am the administrative law judge that has been assigned to preside over this matter. This is the time set for the procedural conference for Docket No. E dash zero one seven eight seven A dash two six dash zero two four three in the matter of the formal complaint of Of Donald Harvey versus Navapachy Electric Cooperative Incorporated. Now before we begin I do see we have Uh several call in users today. Um so I'm going to have all of the parties that are online identify themselves. Um So I will start with the cooperative Navapache. It appears that we have uh two mysterious callers. Um so that that may be an issue with muting, but I at least for now I have the attorneys available. So um let's uh proceed at this time and then we can kind of go from there depending on how um how this starts off. Now um Before we move forward, I do want to provide a quick overview of today's proceeding. As mentioned in my july seventeenth, twenty twenty six procedural order, this procedural conference was initially called to discuss the scope of the Commission's jurisdiction as well as the process and schedule for this matter going forward. However, after the cooperative filed its notice of filing and motion to dismiss yesterday, I did want to pivot to address um where we go from here in this matter.

So I'm gonna start us off with this company. Uh Miss Grable, aside from what has been filed in the docket thus far, is there anything that the company would like to add at this time regarding their motion?

Um, thank you, Your Honor. I don't believe so. I we I the company has had very cooperative convers uh excuse me, come cooperative conversations with Mr. Harvey and they've resulted in a settlement that both parties believe is to their benefit. And so Mr. Harvey has agreed to withdraw his complaint, which is why we filed our motion. All right, thank you.
