that's well I'm I'm glad you're here. We were just uh getting started. Uh we have gotten as far as uh Uh me announcing myself as administrative law judge Mark Prenny and we had uh Division Council Ms. Thomas announced herself. Uh so Mr Brown are are you representing uh yourself and U L assets today or do you have counsel that's calling in?
Uh I am representing m uh both of those parties today. Um Yeah.
Okay. All right. When when we last met on February eleventh, twenty twenty six, uh, for a telephonic procedural conference. Yeah. We had scheduled today's procedural conference as the securities division was awaiting production of documents in response to a subpoena. And Mr Brown had stated he was in the process of obtaining counsel to represent uh himself and U L assets. Uh so I guess let me turn to Ms. Thomas first and ask uh where things currently stand and and what the division is seeking to uh to to have done today.
Uh, Your Honor, uh at this time the division is still waiting on production uh of the subpoena documents. Um, we were fine to give Mr.

Brown a chance to obtain counsel to essentially facilitate um our our subpoena production. Um, with him not being represented at this time. Um We will probably need to have a discussion with him um to get to to get those documents. Um now that he's uh essentially operating himself. Um So that's where the division stands at this time. Um I know Mr. Brown requested a hearing date and I'm trying to look at what the division has scheduled, um, or if it would be more prudent for uh both parties and uh and and the court to set uh a status conference date out a couple of months from now. Um come back at that time to set a hearing date, uh with the expectation that we would be using the time between now and a status conference to get uh subpoena production.
Do you have a recommendation, Ms. Thomas, between those two options?
Um I think your honor my preference would be to set a status conference date, um, probably in about probably about sixty sixty days or so out. Um With uh Yeah, I I I think that would that would be my preference is a status conference date on a in about a month or a month or two.
Okay. Thank you, Miss Thomas. Um Mr Brown, what's the uh status of your uh attempts to obtain counsel?
Well, thank you. Appreciate the question. Um it is my intent to have counsel Um unfortunately, of course, you know, this kind of a Of a hearing notice created a little bit of a uh let's just say a wave in my business. And uh so it's created a challenge to come up with the fifty thousand dollar retainer that it takes to do that. Um and so my apologies for taking the the time, the delay to get to that point, but Uh I think that I've accomplished that uh here today and tomorrow. Uh and so I'll be back in touch with council by Friday and uh expect to be uh engaging them right away. Uh I do not intend to represent myself or UL assets in this proceeding. Um I I do expect to have counsel and I'm uh like I said eminent to be able to engage with them and so uh sixty days or thirty days, whatever whatever extension we need to give.
