Before we begin, since this is a telephonic proceeding, I just uh would like to remind the parties to uh try not to talk over each other, try to Uh avoid speaking until the prior speaker has finished or until you've been called upon. And with that, let's go ahead and take appearances beginning with the securities division.

Good afternoon, Judge Nichols. It's Paul Vrashka from the Phoenix office of Canning Al Kelleher, McLeod. Waterfall. And we represent the respondents in this case.
Good afternoon, Mr. Rashda. All right. Um So I'll I'll turn to Ms. Papson first. Have the parties had an opportunity to discuss potential hearing dates?
Uh we have not.
Um so uh what what dates would the division propose?
So um I just wanna I mean, uh my understanding is that We're looking pretty far out for hearing dates. Um, I'm sure your honor can correct me if I'm wrong.
Uh well that's uh you know it's it's it's up to the parties.
How are potential hearing dates being discussed and what factors influence the scheduling?
You know, obviously there there are a lot of items on the the hearing calendar already, but that's not to say that there isn't availability as sooner rather than later if that's what um the the parties desire.
Okay. Um so as of right now.

I I was just gonna say this is a temporary season fish disorder. And uh for purposes of the record, our clients will waive their right. Or a speedy hearing.
Thank you, Mr Roshka. Um Uh all right. So uh with with that in mind, um Ms. Hapson, uh, what's the division's position? Regarding uh when when we ought to have the hearing.
Um so we currently have um uh documents contained out. Um respondents are going to respond by October second. Um so a hearing date Uh, you know, in order to look over um the documents and uh to continue our investigation, I would be looking at a hearing Mm-hmm. Mm-hmm. Mm, I don't know if asking for January is too far.
Uh and uh Ms. Tapson, I'll I'll just let you know. Uh this isn't to say that this is what we need to do here. Um I'm I am flexible. It's it's really about uh hearing hearing uh hearing room availability and and what the parties would prefer. But I will tell you from my own personal experience, these securities cases are often scheduled uh as as much as twelve months out. So the January is certainly not a problem. If the division would purper further out than that, um again it's there's there's no issue with Um, with with that being unreasonable, it's just a matter of, you know, what the what the parties are
What timeline does the division propose for exchanging witness and exhibit lists?
you know, what the availability the parties are and what the availability the the hearing rooms. Is.
Okay. Um yeah, so uh any time after January, um, I think would be sufficient for the division to um be able to review the the documents um provided by the respondents um and and continue with the investigation. Um potentially Um, I mean I guess if we're looking Farther out, um, I would then I would um ask for for for May of twenty twenty seven then.

Um Yeah, I've got Yeah, I'm a triple A arbitrator and um I I've got a hearing The week of May seventeenth, I've got conflicts. Fifth through the seventh. Um Early June would look better for me if it works for the division and for you.
Right, let me uh Take a look at the Year and calendar here. It looks like the first two weeks of June. Um are available and in fact Really, I think any time during the month of June twenty twenty seven. would work. So I'll I'll turn to Ms. Papson, uh how does that sound?
