This is the time set for the procedural conference for phase two of docket number WS01303A. twenty four zero one three zero. In the matter of the application of Epcor Water Arizona Inc Bantan water and wastewater districts. For a determination of its water and wastewater utility plant and property, for increases in its rates and charges for water and wastewater utility service, and for related approval. Phase two specifically concerns Upcor's application for approval of a formula rates mechanism for the Santan district. Um, so I'll now take appearances for the record.

Right. Okay, so um I Learned today that Mr. Pratt emailed all the parties to let them know that he um was unavailable today or and to say that she needed to be excused. Um My administrative staff then instructed him that he needed to file something like that. He did file it, but he did not include a service list. Um So He's excused today, as is everyone else who doesn't think it's important to participate today. But as a reminder in case Mr. Pratt needs one or anyone else does. Um, all filings that are made in the docket by a party need to include a certificate of service that shows the um addresses, even if they're email addresses, used to provide service to each party. So That's my public service announcement for the day.

Um And let's go on to what we're here for. This was scheduled at Ruco's request, so we can discuss the process and the schedule for this phase two. Um, I also indicated in the procedural order that we would be discussing EPCOR's apparent failure to comply fully with the requirements of decision number eight one four one five. And um Mr Gellman, I saw the supplement that Epcor filed. But I still would like to hear from you regarding um Of course, a rationale for failing to comply with the decision in its formula rates proposal.

Okay. Um Yeah, we were obviously well aware of uh decision eight one four one five and the requirements set forth in I think it was section eight j three. uh of that decision. We covered that in the original request that was filed under uh on September twenty-fifth. We provided testimony uh and evidence to support our position on all the bullet points. that were uh set forth in that decision, including explaining why we were requesting certain deviations that we uh that we were requesting, as well as explaining other things that were listed in the bullet points. Um obviously we did not or I did not specifically cite to ARS 40 fit uh 4252. And uh obviously that that uh lies with me upon seeing the procedural order that was, I think, provided around October first.

Uh, we did provide the supplement uh formally requesting uh what we believe to be all the the bullet points where we were requesting a uh variance or uh divergence from. uh tried to be as complete as possible uh in that in that filing. So we we recognized uh your procedure order and we tried to address it as as quickly as we could.
