And if this is the first time you've attended our meetings, I'd like to thank you and let you know that we begin our meetings with the Pledge of Allegiance and followed by a moment of silence. WE HAVE ANY AGENDA ITEMS THAT NEED TO BE ADDRESSED BEFORE WE VOTE ON THE AGENDA IN THE MINUTES. AND THEN WE HAVE PRESENTATIONS. WHAT ARE PRESENTATIONS? PRESENTATIONS ARE WHERE WE RECOGNIZE INDIVIDUALS OR ORGANIZATIONS OR EVENTS HERE IN OUR CITY. AND THEY'RE PRESENTED BY ONE OF THE MEMBERS OF THIS COMMISSION. R5, the January 13, 2025 draft minutes for the General Employees Retirement System Board of Trustees were added as additional information. PH4, Exhibit 7, the city surveyor schematic was added. It was not available at the time of publishing. And Exhibit 8, a resolution for approval was revised to replace 36.4 feet with 34.4 feet in the header and on page 2. All right. Mayor? DO YOU HAVE A PROBLEM WITH IT BEING DEFERRED? YOU DO. CAN A MEMBER OF THE COMMISSION ASK FOR IT TO BE DEFERRED? OUR CODE DOES NOT PROVIDE A PROCESS FOR THAT. FOR SOME REASON IT'S WRITTEN TO PROVIDE FOR THE BENEFIT OF THE APPLICANT THAT YOU HEAR IT WITHIN 180 DAYS OF THE APPLICATION BEING DEEMED COMPLETE. SO THE COMMISSION CAN'T VOTE TO DEFER AN ITEM? I think it can. So what our code provides, what
you run the risk of is not complying with
your procedural due process. Are you going to throw those fancy terms out? What I'm saying is that the
process that our code has has outlined certain rights for the applicant that they can raise in the future. And now that the applicant has stated on the record that they do not agree to the deferral, you would be hard-pressed. I'm not saying that you can't, but
there isn't anything within our code that provides you with the... ability to unilaterally defer this application. So the applicant has rights, but the property owner doesn't? Right. I think we need to change that. Well, I need some clarification. I read the minutes of HPB, and I'm not sure exactly that that's the case in terms of the property owner. This is a split property. I mean, I don't know if we want to get into this right now, and we can, because I think people need to understand everything, or we just go along with what you're saying and not get ourselves into trouble. When did this go to HPB?
And was this issue of ownership of the property decided at HPB? I mean, can someone speak to us from HPB?
