So we review at the registration stage, which is when you now make an EPA.

It comes to us for review and we check that you're compliant with the Act.

There's a bit involved in this.

I don't minimise that there's a process to be gone through and we're there to provide support.

There's an opportunity for people close to you to step in and say, wait,

Sadly, mother has already lost capacity and couldn't be doing this or that person isn't a good pick as an attorney.

So we have to look at any kind, we don't get too many of those objections, but we must review them and consider them before it makes its way onto our register.

Also, and this is new with this Act, we supervise the performance of an EPA after the second stage so that the attorney who has now had to step in because you have lost capacity to make these decisions

They are, and they're small compared to neighbouring jurisdictions.

In England and Wales and in Scotland, the percentage of adults with an EPA is closer to something like 20%.

I think it's been nobody's job really to promote them before.

EPAs have been around under a prior Act since the mid-90s, but our job in the DSS, and we have several statutory functions, one of them is to promote awareness and confidence.

I think the inhibitors are perhaps several.

People might think, well, I have very little to be worried about.

But it's not just about having significant resources.

You might need your EPA regardless.

There'll always be something for decisions to be made about.

People might sometimes think, well, I only have one close family member, so they'll simply step in.

There won't be a row.

And again, for the reasons I've mentioned, that won't work.
