And in contrast to the Obama experience, where the court shut down a major presidential initiative, these days on the shadow docket, the court is mostly, and indeed overwhelmingly, allowing President Trump's initiatives to go forward.
Political scientists will tell you that there's more partisan voting on the shadow docket than on the merits docket.
That you're much more likely to say,
Republican appointees voting in favor of a Republican president and against a Democratic president than on the court's usual docket, than on its merits docket.
And one example of why this is so and why people, when they're acting fast, might rely on their partisan impulses is in the Biden years.
The court voted against Biden on three different emergency applications, which then eventually returned to the court.
And the court, when it had a chance to do the full thing, to actually give it consideration and deliberation, voted for Biden in those three merits cases.
So in short, the more time the court has to consider cases, the more its partisan impulses are dampened.
And recall that the Supreme Court's public approval ratings, the public's trust in the court, is testing all-time lows.
And its increasing reliance on the shadow docket to make major decisions is only going to make that problem worse.
This is a tragic situation, maybe the worst tragic situation you've ever had.
It is invalidating what is the cornerstone of President Trump's economic policy, sweeping implications for the economy and, of course, for presidential power.
This is a massive, devastating and consequential blow for this administration.
It's also a rare rebuke.

Well, this is a court that's been very favorable to President Trump.
But here we have the first major argued merits decision on really the centerpiece of a domestic and international program.
And the court says that the main statute he relies on does not authorize him to do what he wants to do.
So this is a major blow from a court that not everyone expected to stand up to President Trump.
So this case is about a congressional statute.
