So as a a lawyer, what was the standing of this waiver?

Well again

And you know, lawyers can like sort of run both sides of the fence, but the one thing I do know is it hasn't it hasn't had any effect because it hasn't had to be relied on.

But as I said, there's statutory obligations that you can't contract out of, regardless of what a waiver says, when you're an employer.

And you've also got common law rights as a nondelegable rights that you can't contract out of.

So they were always protecting Jake as he was playing.

So why would it have been necessary?

Well I think that's a question that um yeah that's probably a question for others.

Yeah, so the AFL can't provide legal advice to a club, they're a different entity but

They there were discussions post the um concussion panel about making sure that any player who goes through the panel and then he's potentially still able to play that they understand the risks that come from um playing a contact sport when you've had one or two concussions or whatever the number is.

And so the advice that was provided then was in relation to that.

Could that have been used to

To draft a waiver.

I think they're two different things.

I think, you know, consent and acknowledgement of risk are um

things that are you know, contained either at common law or or in statutory obligations already.

So I think the waiver is the next step which is you know and that's the part that we're looking into why that you know, how did that get there?

Did those inquiries reach your office?

No, at that stage that was something that was handled from the sort of the legal and health care and insurance team.

Again, you you don't y c it's hard on hypotheticals, but I'd like to think that you would ask a question of why that was there.
