But I think actually council can play a more key role in providing you with advice about how to frame your applications, how to frame witness statements and
particularly in relation to gatekeeping orders.
If you dispute something in a gatekeeping order or you want to challenge a direction the court have made, you only have seven days to make a C two application to challenge that.
So you need to be thinking about, for example, if you were wanting to
Challenge the contents of a child impact report.
you would need to potentially consult with counsel as to what kind of cross examination arguments you need to be put in in your application.
to make sure the court understand why it is that person needs to be at the decision hearing to be able to be cross examined.
That isn't something the court would just go in to make a direction for.
You need to absolutely justify it.
Otherwise you're not going to be able to challenge that child impact report.
If you're asking about representation of respondents, then definitely you need to be filing responses.
It may have been previously that responses weren't generally filed and you may have just waited until you could file a statement.
But actually in child focus courts, unless you go in to be putting forward something in your C seven or an additional C one A or a response to a C one A.
there may not be an opportunity before the filing of a child impact report for you to have your evidence or the information that you want the court to have to be in writing before the court.
So certainly encourage respondents to file those documents.
Also, I would encourage anybody who has a a client who's a victim of domestic abuse to make absolutely clear
in their application, what special measures they need, and to continue reminding the court of that.
