But if you are needing to file one, the devil is in the detail.

So you absolutely need to include in there evidence or at least an indication of what evidence you have available that would support the allegations that are being made and maybe suggesting to the court within the body of the application that they may want to consider making a direction for that evidence to be filed.

Cases can move really quickly.

So front loading is very, very important.

So you need to be thinking about things such as collating evidence in advance.

So when you take instructions from a client, you need to be taking a lot more detail than maybe you normally would.

You need to know the timelines.

You need to know all of the detail of the the relationships, how things have got to where they are.

Because all of those things are going to be important if you need to file a statement.

In addition, they may be useful for including in the C one A and the C one hundred, and there may not be a full opportunity to meet out your arguments other than in those initial applications.

So I'd say collate as much information as possible.

There may be a direction for a statement as part of the proceedings, but generally I'm usually given a directions for filing a statement seven days later.

So as you can imagine, that's an awful lot of work to cram into already a busy practice.

So what you need to do is to make sure you've got that evidence available.

So all the information you might need for statements, any exhibits you might need, you need to have them before that direction comes in in reality.

In addition, if you've got witnesses that you want to file evidence from, it would make sense to reference those in your application.

And in doing so, you need to say to the court how the information that witness is going to provide is going to help that court to make a decision about the issues in this case.

There's no point saying, Oh, I've got a witness I want to file evidence from.

You need to say why that's important to the case.

Otherwise the judge probably isn't going to take a great deal of account of it.
