I think that's a cop out.

I think that they couldn't get him to allocute and they were worried he was going to talk crazy, which he probably was, but then they would at least have him under oath saying what happened.

So when he files a motion like this, that's a lot more powerful evidence than him just saying yes to the judge's questions.

I definitely think he's regretting that, but I don't think he actually had the opportunity to do that.

My guess is that Koberger said, I'm not playing if I have to allocute.

And that was never even a chance.

They could not negotiate that because he probably said, nope, not happening.

And then after the fact, the prosecutor's coming up with this great reason.

Oh, this explains why I didn't have him allocute.

But most likely it was a deal breaker for him.

Right, and I mean, that's what he's going for, saying he's got actual innocence, but can he actually prove that?

Because at this point, he's got the burden.

And there's really two ways that he could win this, and one of them is proving manifest injustice, which is essentially actual innocence, because

We think it's unjust to have someone who's innocent serving a life sentence.

But the other one is that his lawyers somehow were ineffective because he says they lied to him about the conditions.

I think that is a bunch of crap, quite frankly.

Nobody thinks they're going to go to prison and have contact visits and employment and freedom of movement.

That is exactly what you give up when you go to prison, freedom of movement.

Freedom of movement, literally in contact with the outside world, like unemployment.

He had links with the Islamic State militant group and was known to domestic intelligence.
