Uh you you can say it was his phone that sent those text messages.

Can you put the phone in his hand beyond a reasonable doubt?

I don't know.

Uh you can say it's his Discord account that that um that sent the confession, but can you put that Discord account on a device of his while he was using it beyond a reasonable doubt?

The prosecution will be tasked with doing precisely that.

If you're going to introduce the confession, you have to prove it beyond a reasonable doubt.

Uh every element has to be

Proven beyond a reasonable doubt, including that confession, if that's what you're going to rest your case on.

So it'll be interesting to see how the prosecution intends to tackle that uh task going forward.

But um, just because there's some text message or a a photograph of a screen cap of a text message doesn't mean that we can say definitively he has confessed.

People are saying that because they have an interest in the outcome of this case.

But um right now,

All we know is he entered a not guilty plea and the prosecution and defense will be getting ready for trial.

You know, I d uh nobody wants to go to trial because you're leaving your fate in a jury.

So i any way you can get out of a trial, if you can defeat it at the preliminary hearing stage or in some states the grand jury stage, uh ideally you would win there.

But uh if if you can't, your only option is to go to trial and try to convince twelve people that you're right and that you or at least that that there's not enough evidence to convict you.

So nobody wants to go to trial, but in the absence of an alternative, it's the only option.

You have to go to trial.

So I I think you know, the defense will get ready for trial.

I I hear a lot of this that, oh, the defense didn't put on a defense at the preliminary stage.
