Well, they're not really I mean, they're allowed to, I guess, but it doesn't really have much value.
The way a preliminary hearing works is the judge is not allowed to pick from competing inferences.
So if there's any inference
At all, he can judge that the state has has proven its burden, has met its burden.
Even if the defense comes in and puts in a viable defense, the judge is not allowed to consider it.
If if if there's any reasonable inference that can be drawn in favor of the state having met its burden, the judge is required by law to
to to accept that and to find that the state met its burden and bind it over for trial.
So it really would have been a waste of time.
It would have been a preview perhaps of their defenses that would have given the state an unfair advantage going into the trial.
So it didn't shock me at all that they didn't do a whole lot.
