The only thing I can think of, and this is a little bit of a stretch, but it's really the only thing I can come up with for the way his defense team has acted to date, is that they are so confident he did not pull the trigger.
And they are so confident that their defense is going to acquit him on the actual murder
that if they can just get a jury and paneled on that issue, they can win on the rest because he won't have been charged.
You don't want to say anything right now that's going to result in the state bringing charges as an accessory or a getaway driver or a supplier of firearms or anything like that.
Let's just get to trial on the shooting.

Let's just get to the jury.
And then from there, once we get Jeopardy attached, we can present our defense and we can get them out of this.
That's the only thing I can think of.

And so saying a device was somewhere is not definitive proof a person was somewhere.
