I think technically with the formula rate filing, it's really no different than the rate case where the utilities tend to brief each of the offices, staff, RUCO, the other parties that could potentially file. podcast-host

So my suggestion would be to just build in an ex parte date into the POA. podcast-host

I think that would give the clear line you're looking for because I could see the commissioner's concerns, the chair's concerns about podcast-host

What if there's another CeraVal issue and the company needs to come and brief you on what their plans are? podcast-host

If ex parte is invoked in perpetuity or at least until the next trade case, they wouldn't be able to do that because at some point they'd be seeking recovery of that investment. podcast-host

But I think if you put in an ex parte date in the formula rate POA, and it should be the date of the filing, in my opinion, whether there's a hearing or not, I think that gives you the clear line, knowing that now there's a request pending for recovery of whatever investments have been made, but you will still have had the opportunity to have had that briefing and be made aware of it. podcast-host
