So it's my recollection, Mr. Brasso was correct, at the time of the Tax Cuts and Job Act back in 2017, 2018, the Commission opened a generic docket and they gave the utilities three options.
essentially approval of an accounting order where you could track and defer those for future recovery or refund in a rate case, filing a rate case, or some alternative mechanism.
Robeson at the time for their Coal Creek and Lago systems chose that third option of some kind of mechanism.
To the best of my memory, I don't know that they officially had a team or a tax expense adjuster mechanism approved.
So much as the commission directed them, here's the amount of refund you have to refund to your customers based off the customer account at that time.
And then they required an annual true up and quite frankly, staff essentially got tired of having to do that every year.
And after the sixth, I think time we had recommended to the commission that they direct ropes into file rate cases, which is part of the reason why we're here today.

Because what we were seeing was a refund.
It was, I think, a little over $2 a month per customer.
And because the customer accounts fluctuate on a monthly basis, we'd get to the end of the year where they would have over-refunded what the commission ordered.
And then they would file this true-up, and it would be a one-time surcharge.
to capture the over-refunded amount.
And we thought it would be cleaner and easier if they just filed a rate case and adjusted the income tax rate in a rate case.
As Mr. Barasa said, after the first handful of large utilities filed their rate cases, they kind of held the team mechanism.
but it was for some of the associated impacts, so the amortization of the unprotected excess accumulated deferred income tax.
I think most of those have been resolved now, and those utilities, some of them have kept the team mechanism in place just in case.
Others have just requested that it go away.
I think similar to what happened back in 2017, 2018, if the feds at some point decide to increase the income tax rate again, the companies can seek recovery of that increased expense.
At one point, they were actually contemplating that.
