So this piece of evidence um was initially excluded from being used by the prosecution.

And what it was was it was some pictures found on an SD card at Patterson's home of a bunch of wild mushrooms.

They were taken in the year 2020, so this is like three years before.

and it was ruled inadmissible by the judge, um, Christopher Beale.

later on, um, during the trial it was introduced by Aaron Patterson's legal team into the trial and um

These pictures were shown to the jury.

And what the defense was trying to say was this is proof that Erin Patterson has a longstanding history of foraging mushrooms.

Because remember, their argument all along was that this was a tragic accident.

Um Erin Patterson never intended to serve these people deathcap mushrooms that she picked from the wild.

Now what the defence is saying is problematic.

Um and the reason for that is

They say today that if the prosecution put that evidence forward

Um they would have had to have found a witness to to do it through, and then Colin Mandy, the barrister at the time, could have cross examined um the prosecution about the merits of this evidence.

But because the prosecution couldn't do it, the defense needed to put up a witness to introduce this material.
