I don't know the answer to that.
Maybe in future if there are other trials where um the jury's sequestered, they won't make the same mistakes.
But uh yeah, obviously it was not an ideal situation and and something that um if people had their time over um would would have been done differently.
This was a double appeal, and so far all we've heard is Aaron Patterson's conviction appeal and the prosecution responding to that.
So tomorrow the prosecution will finish their argument and then they'll get to go first for appeal number two, which is their bid to
um get rid of Erin Patterson's non-parole period.
She was sentenced to life in prison, but Judge Christopher Beale um did give her the opportunity of walking free after thirty-three years in jail.
The prosecution says given it was a triple murder and an attempted murder.
The notion of any chance of walking free means the sentence is manifestly inadequate and they will be arguing that um she should be locked up for the rest of her life.
The defence will obviously be arguing that she should have a chance to one day walk free.
Six weeks later, a grim discovery with Miss Bell's remains found at a Dandenong tip.
The defence was saying that the way the prosecution had run the case was very unfair towards Gagnev because they'd chopped and changed the accusations against him constantly.
And they said that was the abusive process.
At this stage of the case, they weren't actually taking aim at the specific charges.
current allegations, it was more the way things were done.
And so they went to Justice James Elliott calling for a permanent stay saying, this has gone on for too long.
It's time to get rid of this case because it's been, as they describe it, so unfair.
The prosecution said, no, this is a perfectly fine way to go about things.
We always reassess cases as they progress.
And that sometimes means that charges do change.
