We spent the bulk of today and yesterday arguing about nothing to do with the evidence in the case, but with rights of third parties.

And it's appropriate for the court to consider that.

But at some point, I think the court has to return to the purpose of these hearings, which is to expeditiously hear the evidence and then determine probable cause.

And I want to point out to the court, Ms.

Kirk has been very adept at holding press conferences at which she has revealed evidence.

She has represented that the state is her attorney.

She has access to all the evidence that the state has publicized and that the media and her own lawyer argues is already in the public domain.

So they're perfectly free.

This is strategy, Megan, because Erica Kirk and the Kirk family, they're advocating for transparency, for open access to evidence because they fear the conspiracy theories and they want the world to see the reality of the crime.

And so what the defense is trying to do is to spin that into improper tainting of the jury pool as trying to prejudice the future jury pool.

So they're trying to go after not just the Kirks, but transparency as a whole.

saying transparency harms our class right to a fair trial.

And they can't really say that transparency is bad because everyone likes transparency.

So they're doing it in a way by saying, Eric or Kirk and the other side and the prosecutors, they're doing something untoward and improper.

It's strategy, and I don't think it's working.

Well, let's preface this by saying he would be right if what he said were to be true.

So if all of the facts that he alleged that they're going out there and themselves poisoning the jury pool, if he's right on the facts, then he's right on the conclusion.

It would be improper.

The only problem is and I did my best to see what she said.

Did she talk about any evidence that was not disclosed to the public?
