I mean, if that, in fact, if you actually want a specific balance, I mean, it's a private institution.

It should be free to do that if it wants to do that.

Well, I mean, it's unavoidable if you're trying to create a mix.

If you have a notion of diversity and it should represent, if you're saying that

I mean, this was clearly not their policy, but let's say their policy was, we want our student body to mirror the general population.

And the general population in the United States has 58% white people and 14% black people and et cetera.

so we're going to get we're going to get our 14 percent blacks black students in the freshman class how do we do that right there are better and worse ways to do that now now you might think that's just an odious goal we should we should be colorblind and post-racial and we should just want you know good kids of whatever color in in our school that's that's also a defensible goal right and and you know i would probably be more in line with that frankly but you

Even if you just wanted to mirror society perfectly, if that were your goal, there are better and worse ways to do that.

And the worst way to do that, which was the way that has been practiced with affirmative action in most places, is to lower the standards, right?

And to leave people with the feeling that there's something...

There's something bad about affirmative action because the person got into the school on something less than their own merits, right?

And it's bad for the person who got that advantage and it's bad for everyone else's perception of them.

And it's not necessary.

I mean, because under a different system, it would be understood that

No, everyone had the same scores.

Everyone jumped through the same hoops.

We just went the extra mile to find people from each community who could do that because we cared about diversity, right?

That was possible.

And that's not what any of these schools tended to do.

Honestly, there's been so much research done on this.
