What's the randomness in a legal contract?
The randomness is, okay, so first of all, I've written this contract with you.
First, is this contract going to be enforceable?
Sometimes it's not.
Like, for example, let's say I put you under duress.
That means that you can negate the contract.
You can't tell from the contract whether you're under duress.
I can't tell.
But if you can prove it to a judge, you can negate the contract.
Okay.
Second, what jurisdiction are we going to be in, right?
You're in Asia, I'm in the U.S.,
Where is this contract going to be adjudicated?
Maybe we say we're going to do it here, but maybe we fight about it and we do it over there.
And now the rules are totally different, right?
Third thing is, okay, let's say we actually go to court.
We go to court.
Who's the judge?
The judge is random.
It's literally done by a lottery.
