variation application and whilst we all know a variation application should not preclude the hearing of the enforcement proceedings or the concluding of those.

Judges have a tendency to deal with things in different ways and start combining things and making things contingent on outcomes of other things, and it can all get a little bit messy.

But is another consideration as I think Anita was just helpfully touching on, and we'll come on to third party debt orders.

But if for whatever reason you think that

they do have the means to pay and

me issuing a general enforcement application is going to either trigger some form of dissipation or a a variation on rather spurious terms, and you want to secure those funds

then that's great.

I think the other point that just came to me as we were talking is about how actually if you do have concurrent variation uh proceedings and enforcement proceedings, and Chris and I experienced this recently, it can actually be quite helpful that you have the disclosure

in the enforcement proceedings, which might be of a different level to the disclosure that you would otherwise get in the variation proceedings because obviously it's different forms and you have the ability to cross examine in the enforcement proceedings.

There's lots of technicalities around what you can rely on across the two sets of proceedings, strictly speaking.

But once it's kind of out there, we all know that a a judge is not going to be

too strict about you wanting to rely on disclosure that you've got in enforcement scenes 'cause you've got a pretty naughty person, trying to then hide behind that in their variation application.

Well that probably gives a little bit too much away in terms of how exciting Chris and I live our lives because these are the ones that get me a little bit more excited and um

In my experience these tend to really be sort of the the first port of call, the first ex parte application.

that's usually made ahead of the general enforcement application.

If you if you know that there is something that you effectively want to get your hands on early doors

then to obtain that interim third party debt order hopefully secures those funds ahead of enforcing the direct payment to the applicant.

By the third party that's holding those funds.

The caveat to that is is unlike what Chris was just saying about charging orders, these can't be against any accounts that are held with a third party.
