So I have to a step back and say as the city attorney alluded, it would be up to the city commission and their comfort level if they'd want to accept it without staff doing that initial evaluation.

There would n be nothing that stops you from doing that according to the city attorney.

Uh option C if we would move forward with that, I think staff would then be trying to finalize the negotiation with the owner's representative.

I think we'd need clarification from the city commission if you'd want us to issue the design criteria package and start that formal solicitation process or if you want to wait and see how the unsolicited proposals go.

So I think there's still some additional direction that would be as part of option C.

So with option C, the clarity I would want from the Commission is

Finalize the owners' rep negotiations and bring back uh an agreement for your consideration.

Right?

That's something we could do.

Um the second thing would be would you want us to issue a design criteria package so that way we continue to move forward with the city led initiative?

and see what happens in the meantime with the unsolicited proposal.

And then the third one would be

If you have a desire to accept the unsolicited proposal by Meridian and do a notice of intent for a comprehensive agreement and create a competition period, unfortunately I can't answer if that would be tonight or if it'd be the next meeting or the one after that would be a commission decision.

I would defer to city attorney.

My understanding is they they may.

We've received amended and modified unsolicited proposals in the in the past.

I'm not sure once the acceptance is done what that limitation would be.
