I proposed to add in the council procedures menu removal comes to the council for final decision because I think there might be certain instances where we might now want to automatically remove so okay and that's something a city attorney raised in the staff report we want to

I disagree.

I don't think Commissioner's handbook should have any policy proposal in there.

If there is any policy on how we remove commissioners, it should be in the council procedures menu.

So if there is inconsistency, we should fix the commissioners handbook to comply with the council.

But then I don't, but also I feel strongly we shouldn't automatically remove a commissioner because of attendance.

Because the requirement, yes, it could be different circumstances.

It takes us a lot of time to interview people, especially because a lot of times they have a lot of special meetings, very little number of regular meetings.

You send me 25% of that, maybe it's a very small number of meetings, right?

Because they attended special meetings, I don't know the whole story.

So that's why I thought the council should have the final say because we appointed the commissioner and we should have final say in removal.

It could be on consent if no disagreement.

In the staff report, it says currently this commissioner's handbook states that it is improper for an individual commissioner acting in their official capacity to try to persuade the council into the acceptance of a recommendation other than that voted by the majority of the commission.

So the issue of quasi-judicial, this applies only after the commission has voted on it.

So after they have voted on, can they express their opinion and try to persuade the council for their own opinion?

That shouldn't have any legal issue, right?

Does that make sense?
