The agencies have their own internal rules on how to respond to subpoenas.
Those rules are called TUI regulations.
And so the BBC's lawyers did exactly what the law envisions.
They served the subpoenas on the federal agencies, and then they began the dialogue with the agency's lawyers.
It's an accommodation process, and there's no role for the DOJ in this process.
Well, at this stage, they're only sort of mumbling about it because they don't want to say the reason.
And the reason is that they're going to assert executive privilege.
This is a kind of a redux of a fight that took place in the first Trump administration.
Well, that is a question, right?
Steve Bannon claimed executive privilege for his conversations with Donald Trump.
And of course, Steve Bannon was not in office.
I think he was a part of the first Trump administration until about 2017.
I think he lasted like three months or something.
What the government is trying to maneuver itself in position to do is make really expansive executive privilege claims.
And the way that they're doing that is to ride in on these subpoenas of the federal agencies to try and use them as a sort of a Trojan horse to bring their hundreds of lawyers inside this BBC civil case.
And that would be mighty convenient for Trump and Brito because at this point Brito is kind of suck and win.
And that is indeed what every court to consider the matter has said.
What happened in 2020 is that Bill Barr attempted to substitute the United States government as the defendant in the Carol v. Trump case on the theory that Trump was, as you said, doing official president stuff when he said Carol was too unattractive to sexually assault.
Which sounds crazy, but Bill Barr was relying on a real law.
