It's a medical decision.
And these people on the bench, they're just some bloke you don't know, some woman you don't know.
They don't know your kids from a bar of soap.
So they are not going to make decisions.
They're not on
for the child.
And really, although they might take notice of a psychologist's report or something, they actually don't want to be involved in decisions going forward for everything.
So now, since the amendments in May 2024, they talk about having parental responsibility and each of you can do whatever you want in your time, as long as the third party agrees and you each have those powers.
If there's a dispute and it's bad for the child, then
If you bring an application to the court and they put in theirs and go, no, we don't need homeschooling, we don't need this doctor, we don't need this, the court's going to say, the parties are in dispute.
I don't necessarily have to prefer the mother's over the father's point of view, but what I am going to do is give the sole decision-making for those things to the mother or to the father because that's where the child lives the most.
So they will strip rights off you if they go to court.
And it's come about because for years we had disputes over what school.
And the judge is going, I don't know which school a child should go to.
So they've now put that decision making back in the parents' hands.
And they're saying, slug it out.
But if you can't agree, come to us and we'll pick a winner.
