can waive that.

If there is a restrictive covenant in favor of a private individual or a corporation, that corporation can waive it.

but they have to waive it.

In this particular case, can you tell us, or maybe this is a Maite question, can someone tell us who the restrictive covenant was in favor of, and have they waived that restrictive covenant?
