What do we know about this suit, and what don't we know?
Well, Chris, we don't see a complaint yet filed on the federal docket.
We know that Mark Kelly has filed a civil lawsuit in federal court in Washington.
That's the U.S.
District Court for the District of Columbia.
And what we know about the suit at this point is limited to what's described as the nature of the suit.
Every federal lawsuit has sort of a caption at the top electronically that describes what the cause of action is.
Here it says that Mark Kelly is challenging an agency action under the Administrative Procedure Act.
Likely what his claims sound in is basically saying that Pete Hegseth's decision to initiate a process that could demote him in terms of his ranking or deprive him of his pension is an arbitrary and capricious decision in violation of the Federal Administrative Procedures Act.
Again, we have not yet seen the complaint.

the other thing that we know is he's likely to be represented by paul fishman paul fishman was a u.s attorney for the district of new jersey previously he has represented a number of other people who are facing adverse action from the trump administration it will be interesting to see if paul fishman indeed represents mark kelly in this lawsuit as we expect
