And so there's some truth to the fact that while the standard is still a tough one to prove.

Um, getting past the motion to the Smith is is is challenging in and of itself.

My concern arises with respect to how new and emerging areas of risk

uh will comfortably fit or not within the care mark construct.

And and to me the most obvious are those that are associated with A AI.

and operating within the healthcare company.

Uh, we're not talking just about the risks associated by how AI is deployed by the healthcare company itself.

We're also talking, I think, uh on how AI is personally applied by employees, executive officers of the healthcare company in their own work.

Personally, professionally or whatever.

uh you know and perhaps without corporate knowledge.

You know, there's been a lot of conversation, or I guess.

uh expression or hope the care mark will apply

uh to uh board oversight of AI related risks.

But we don't know that for a fact.

There have been no cases and so we don't really know if indeed it will be very difficult to assert a care mark claim against a health care board for some type of AI issue.

And as we know, we don't have any legislative guidance on this at all, assuming that

states will uh have their roles uh replaced by a f by the federal government.

Uh so I I think that

We have to be mindful that there still is not clear guidance on

board the standard of conduct with respect to AI oversight.
