And so that all of that is tragic.
As far as I am concerned, what then happened in the trial compounded that tragedy.
And at the, um, Carmela was found guilty and he was sentenced to 35 years and, um,
He was 17 at the time that the stabbing took place.
Normally, other places in this country, around this world, Texas is one of the rare places where it doesn't happen.
Normally, somebody who's 17 would be going through the juvenile system, would be processed through the juvenile system, assessed in the juvenile system, and then whether or not they're going to be tried as an adult would be subject to a hearing and determination.
It's not that it doesn't happen.
Sometimes it does.
but it would start in a track that acknowledges that the young person who is accused of committing a crime does not have a fully developed frontal lobe yet, is still considered a youth, a minor.
That didn't happen.
He was bound over for trial as an adult.
And so the circumstances that unfolded from there, we are now frankly just in the appellate process getting to learn.
There is a brand new appellate team
who is handling his case.
It is led by Russell Wilson, who is a veteran criminal defense and appellate attorney in Texas.
The second in command is Mike Young, excuse me, Mike Ware, and he is a Texas Criminal Defense Hall of Famer.
and they are leading a team of lawyers who have now filed a motion for new trial and a motion to recuse the judge, Judge John Roach.
They are not, they did not file this based on the things that have been going around the internet, which is why I said, we have to kind of deal with the facts that we have known, not deal with the stories.
And one of the things that happened in this trial
is that the press was shut out.
