And so the circumstances that unfolded from there, we are now frankly just in the appellate process getting to learn.
There is a brand new appellate team
who is handling his case.
It is led by Russell Wilson, who is a veteran criminal defense and appellate attorney in Texas.
The second in command is Mike Young, excuse me, Mike Ware, and he is a Texas Criminal Defense Hall of Famer.
Um, and they are leading a team of lawyers who have now filed a motion for new trial and a motion to recuse the judge judge John Roach.
They are not, they did not file this based on the things that have been going around the internet, which is why I said, we have to kind of deal with the facts that we have known, not deal with the stories.
And one of the things that happened in this trial.
is that the press was shut out.
Court TV, Don, was having conniption fits about it, that no cameras were allowed.
Press was limited in the amount of time they could be in there.
There were like 10-minute intervals where people had an opportunity to get into the courtroom.
If they didn't make it in that 10 minutes, it was shut out for the rest of the day.
And so the new trial motion is saying that there was interference with Carmelo's decision whether to testify.
that improper jury instructions were given affecting self-defense claim, that there were violations of the right to a public trial, and that there was a breach of an off-the-record agreement regarding character evidence.
And so this doesn't have anything to do with the Batson challenge.
I'm sure that they'll get to the fact that there were no Black people on the jury at some point down the road, but this new trial motion is about that.
And the motion to recuse the judge is about the fact that the judge, Judge John Roach, chose to have a presser.
at the end of the trial and invited all this media to come in after he's the one that kept the media out the whole time, right?
Sat down and gave some comments that are raising eyebrows even in conservative circles about the trial, about why he did things the way he did them.
